General Terms and Conditions (GTC) for the stay in the Welz-Haus Universität Würzburg GmbH

§ 1 Scope of application

(1) These terms and conditions apply to contracts for the rental of rooms for overnight accommodation and/or event rooms for the organization of conferences, seminars, events, courses etc. as well as all services provided to the guest by Universität Würzburg GmbH.

( 2) It is generally prohibited to sublet or let the rooms or function rooms to third parties for a fee or free of charge or to use the rooms for purposes other than accommodation.

(3) Deviating conditions shall only apply if this has been agreed in writing in advance.

§ 2 Conclusion of contract, partners, liability & statute of limitations

(1) The contract is concluded upon acceptance of the guest's booking request by Universität Würzburg GmbH. The University of Würzburg GmbH is at liberty to confirm the room booking in writing.

(2) The contractual partners are the University of Würzburg GmbH and the guest. If a third party has made the booking request on behalf of the guest, it shall be liable to the University of Würzburg GmbH for all obligations arising from the accommodation contract.

(3) All claims against Welz-Haus, which is operated by the University of Würzburg GmbH, are generally subject to a limitation period of one year from the beginning of the regular limitation period under Section 199 (1) of the German Civil Code (BGB). Claims for damages lapse after five years regardless of knowledge. The shortening of the limitation period shall not apply to claims based on an intentional or grossly negligent breach of duty by Universität Würzburg GmbH.

(4) This limitation of liability and short limitation period shall also apply in favor of the University of Würzburg GmbH in the event of breach of obligations in the initiation of the contract and positive breach of contract.

§ 3 Services, prices, payment, offsetting

(1) Universität Würzburg GmbH is obliged to keep the rooms booked by the guest available and to provide the agreed services. Should it not be possible to provide the booked room or an alternative room for a specific reason - such as force majeure, natural disasters or unscheduled renovation work or capacity exhaustion - the amount payable shall be reduced proportionately or, if necessary, refunded in part or in full.

(2) The guest is obliged to pay the applicable or agreed prices of the Welz-Haus operated by the University of Würzburg GmbH for the provision of rooms and other services used by the guest. This also applies to services arranged by the guest.

(3) The agreed prices include the applicable statutory value added tax. If the value added tax increases on the day the service is provided, the agreed prices shall change accordingly. The University of Würzburg GmbH is entitled to charge VAT retrospectively.

(4) In the case of a rental period of six months or longer, the statutory VAT liability does not apply. The decisive factor here is that the room is rented for at least six months at the time of booking and that the actual rental period without interruption is not shorter than six months. Should a change in the VAT liability occur due to a change or termination of the contract, the University of Würzburg GmbH is entitled to charge the applicable VAT to the guest.

(5) If the period between conclusion and fulfillment of the contract exceeds 4 months and if the price generally charged by the University of Würzburg GmbH for such services increases, the University of Würzburg GmbH may raise the contractually agreed price appropriately. (6) The prices may also be changed by the University of Würzburg GmbH if the guest subsequently requests changes to the number of rooms booked, other services or the length of stay and the University of Würzburg GmbH agrees to this.

(7) Unless otherwise agreed, invoices issued by the University of Würzburg GmbH without a due date are payable in full within 10 days of receipt of the invoice. The University of Würzburg GmbH is entitled to declare accrued receivables due at any time and to demand immediate payment. In the event of late payment, the University of Würzburg GmbH is entitled to charge interest at a rate of 5% above the base interest rate in accordance with §247 BGB. The customer shall reimburse reminder costs of €5 for each reminder sent after default has occurred. All other costs incurred in the course of debt collection shall be borne by the customer.

(8) Universität Würzburg GmbH is entitled to demand an advance payment of 10% of the final rental price upon conclusion of the contract. The amount of the advance payment and the payment dates may be agreed in writing in the contract.

(9) The University of Würzburg GmbH is entitled to demand a down payment of 10% of the final rental price from the customer at the beginning and during the stay within the meaning of No. 7 above for existing and future claims arising from the accommodation contract, insofar as such a payment has not already been made in accordance with No. 7 above.

§ 4 Check-in and key cards

(1) At check-in, guests receive a key card which is used for access to rooms and buildings. This must be reactivated daily at the entrance door.

(2) If the key card is lost, a flat rate of € 30 will be charged. Replacement cards can be requested from housekeeping if required.

(3) The door must always be locked when leaving the room. For security reasons, the entrance doors to the courtyard and the clinic street must always be kept closed. On departure, the key card must be left on the table in the room.

§ 5 Rules of conduct for the use and stay in the rented rooms of the Welz-Haus

(1) Careful handling of the property of the house is assumed. The furnishings of the guest rooms as well as all furniture and other furnishings of the entire house are to be treated with the utmost care. Damage caused by improper use or willful destruction by the guest will be charged to the guest.

(2) Irrespective of who is responsible for damage to the inventory or premises, the guest is obliged to report any damage immediately to the property management.

(3) The house rules in their current version form an integral part of the GTCs.

§ 6 Information on the premises

(1) Access to and use of the first floor of the Welz-Haus is barrier-free; there are two barrier-free rooms here. Please note that access to the upper floors is currently not barrier-free.

(2) A cleaning service is provided by the house once a month for a fee. Bed linen and towels are changed. The interim cleaning is communicated one week or seven days in advance by the property management via electronic notification. In order to ensure that the cleaning staff can carry out the planned cleaning work properly, the room must be tidied up in advance and all objects removed from the floor. Should the cleaning staff be forced to remove objects from the floor or to tidy up in order to carry out the cleaning work, additional cleaning costs may be charged.

(3) In order to carry out necessary repair, maintenance or servicing work, authorized specialist personnel (e.g. tradesmen) are entitled to enter the rooms with prior notice. In urgent cases, in particular to avert danger or in the event of acute technical problems, access may also be granted without prior notice. The guest is obliged to allow access and to remove any obstacles.

(4) There is no air conditioning installed in the rooms. Please note that room temperatures may rise, especially in the summer months. Despite regular ventilation and other measures, heat build-up cannot always be completely avoided. Users are asked to adjust accordingly.

(5) Use of the rooms available to the community, such as the kitchen and launderette, is possible; however, there is no entitlement to use. If use is not guaranteed at times, there is no entitlement to a reduction in rent.

(6) The University of Würzburg GmbH points out that construction work may take place next to the building in the future and that construction noise cannot be ruled out. In the event of existing construction noise, the guest shall not be entitled to a rent reduction.

(7) Furthermore, it should be noted that the Welz-Haus is located in the middle of the old town of Würzburg and therefore nocturnal disturbances by third parties cannot be ruled out and incidents of this kind cannot be influenced by the University of Würzburg GmbH.

§ 7 Liability of the landlord

(1) The University of Würzburg GmbH is liable for its obligations arising from the accommodation contract with the diligence of a prudent businessman. Liability is excluded for damages resulting from slightly negligent breaches of duty. Liability for gross negligence and intent remains unaffected.

(2) The University of Würzburg GmbH accepts no liability and will not provide a refund if the guest does not make use of booked services in whole or in part - in particular as a result of circumstances for which the guest is responsible, such as a missed flight, late arrival, non-arrival or premature termination of the trip.

(3) Universität Würzburg GmbH is also not liable for loss, theft or damage to the guest's personal property, unless this is due to gross negligence or intent on the part of the provider. Guests are responsible for securing their own property. Liability for indirect damage, consequential damage or loss of vacation comfort is excluded.

§ 8 Changes to the house rules

Changes to the house rules can be made at any time and can be viewed at reception.

§ 9 Cancellation by the customer

(1) If the customer cancels the booking, the deposit of 10% of the final rental price will be retained.

(2) Cancellation by the customer of the contract concluded with the University of Würzburg GmbH requires the written consent of the University of Würzburg GmbH.

(3) In the case of rooms not used by the customer, Universität Würzburg GmbH is authorized to debit the normal applicable costs.

(4) The University of Würzburg GmbH shall be free to charge a lump sum for the damages incurred and to be compensated by the customer. The customer is then obliged to pay the contractually agreed price for accommodation. The customer is free to prove that no damage has been incurred or that the damage incurred by Welz-Haus is lower than the lump sum demanded.

§ 10 Withdrawal from or termination of the contract by the University of Würzburg GmbH

(1) If the contractually agreed advance payment is not made after expiry of the stipulated deadline with a threat of refusal, the University of Würzburg GmbH shall be entitled to withdraw from the contract.

(2) The guest house reserves the right to terminate the existing contractual relationship with immediate effect and to prohibit guests from continuing their stay if they violate the house rules or cause damage to staff, other guests or the house through their behavior. This is the case if services are booked with misleading or false statements of material facts, e.g. in the person of the customer or the purpose; the University of Würzburg GmbH has reasonable grounds to believe that the use of the service may jeopardize the smooth running of the business, the security or the reputation of the Welz-Haus in public; there is a violation of the scope of application described in paragraph 2.

(3) In the event of harassment or stalking, the tenancy shall be terminated immediately without notice and without stating reasons for the protection of all guests.

(4) If the customer holds unauthorized events in the rooms or outdoor areas of the Welz-Haus of the University of Würzburg GmbH, the University of Würzburg GmbH is entitled to prohibit and terminate such events and to exclude the customer from further use. Further claims (e.g. for damages or reimbursement of costs) remain unaffected.

(5) The University of Würzburg GmbH must inform the customer of the exercise of the right of withdrawal without delay.

(6) In the event of justified withdrawal by the University of Würzburg GmbH or prevention of an unauthorized event by the University of Würzburg GmbH in accordance with §15 No. 4, the customer shall not be entitled to claim damages.

§ 11 Final provisions

(1) Amendments or additions to the contract, the acceptance of the application or these terms and conditions should be made in writing. Unilateral amendments or additions by the customer are invalid.

(2) The place of performance and payment shall be the registered office of Universität Würzburg GmbH.

(3) German law shall apply.

(4) Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
